Website term of Use

1. Definitions

These Terms of Use concern the website www.borzen.si and the related websites, which the controller has installed on this website (hereinafter referred to as the website).

1.1. The owner and controller

The terms ‘site owner’, ‘data controller’ or ‘controller’ in these Terms of Use apply to the company Borzen, d.o.o., Dunajska cesta 156, 1000 Ljubljana, Slovenia, e-mail address: info@borzen.si.

1.2. The user

A site user is any person who uses the website as a visitor and/or as a subscriber to the company’s e-newsletter.

2. Acceptance of Terms of use

By accessing or using this website, the site user agrees to be legally bound by the Terms of Use, confirming that he or she is familiar with and agrees with the Terms.

3. Data Protection

3.1. Collecting and processing of personal data

Borzen, d.o.o. collects the following personal data on the website:

The data shall be processed exclusively for information purposes on topics related to energy and for compilation of general statistics on the use of the website.

In accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the controller shall process personal data only when the site user has given his or her personal consent.

In case of the use of the website, the personal consent is considered to be an active consent of the site user who agrees with the processing of personal data by accepting the Statement of consent for the processing of personal data.

The controller does not assume responsibility for the credibility, accuracy and currency of the personal data and contact information provided by the site user. As a site user, it shall be your own responsibility to provide for the accuracy and currency of the information provided within the website.

3.2 Collecting and processing of other data

Visits to the website

The website may automatically collect some information about the user's computer hardware and software. This information shall only be used for compiling general statistics on the use of the website. This information includes:

  • the IP address of the device used to access the website;
  • the type of browser;
  • the domain names;
  • the access time;
  • the addresses of the websites the user has visited on the website.

This data is collected using cookies. Cookies are essential for providing user-friendly online services. The most common e-commerce functions would not be possible without cookies. Cookies make the interaction between site users and websites faster and easier. Without cookies, it would be very difficult for a website to remember the user’s preferences or registration details for a future visit, thus they save time and make the browsing experience more efficient and enjoyable. Cookies are used by most websites, as they enable a convenient way of keeping contents fresh, appropriate and in accordance with the interests and preferences of a specific site user.

3.3. User rights

In accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the General Data Protection Regulation), the user has the following rights:

  • the right to have their personal data corrected if they are inaccurate;
  • the right to achieve permanent erasure of their personal data in certain situations provided by the regulations;
  • the right to receive information as to which of their personal data has the Company acquired and the right that the Company transmits those data to another controller at the user’s request;
  • the right to restrict the processing of their personal data in the manner provided for by the measures of the General Data Protection Regulation;
  • the right that the Company informs the user without undue delay of any violation of their rights;
  • the right to withdraw their consent at any time if the user has entrusted the Company with their personal data with consent.

You can exercise the abovementioned rights by contacting Borzen with a request for the protection of personal data. We shall provide information on action taken on your request without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests.

You have the right to file an appeal or a written notice against the decision on your rights to the Information Commissioner within fifteen (15) days of the receipt of the notice or decision by the controller. You also have the right to appeal due to the controller’s implied refusal decision.

The rights and procedures for exercising the rights of the data subject are defined in the Rules on the protection of personal data, which are available on Borzen’s website www.borzen.si.

3.4. Personal data storage period

The data shall only be stored and used for as long as it is necessary to achieve the purpose for which the data were processed. After completing the purpose of processing, the controller shall ensure that personal data will be deleted and that the access to the collected personal data shall be blocked.

3.5. Control and protection of personal data

The data controller is Borzen, d.o.o.

Borzen d.o.o. undertakes to protect personal data in accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. The data will only be used for internal purposes and will not be transmitted to third parties.

4. Copyright

The website contents are a copyright work, the copyright holder is the controller and it is subject to copyright or other forms of intellectual property protection. The copyright and other intellectual property protected contents include the texts along with the entire visual image of the website, including all the visual elements.

It is forbidden to dispose of any content, which includes (but not limited to) modifying, copying or publishing any content in whole or in part without mentioning the source.

5. Amendment to the Terms of Use

The controller reserves the right to amend or supplement the Terms if Use at any time and without prior notice. Before using an individual website, we ask the user to check the date of the last modification of the Terms of Use.
